# Guilty

So basically, Shabir Shaik is guilty. Now, if the dude giving the bribe is guilty of corruption, then surely the dude receiving the bribe is too? Will deputy president Jacob Zuma find himself being prosecuted soon? The bullshitometer is in the red already, with COSATU and the like pointing out that Zuma should be presumed innocent until proven guilty. That's a noble ideal, but let's get real here. If one side is guilty, so must the other be.

It's going to be interesting to see what happens next.

Yeah the honorable thing would be to step down, but sice when have honour and politics ever mixed? :-) The truth actually is that following the letter of the law, Zuma is innocent until proven guilty. In any case I think the ANC will think twice before putting his name forward for the top job.

I think so too. Well, I *hope* so. As far as the letter of the law - I agree - insofar as whether Zuma finds himself up on corruption charges or not. In terms of whether he still has a job on Monday - that's a different story :)

One person can be guilty of giving a bribe whilst the person receiving said bribe may not actually be a party to it nor extend the favour/bribe in return.

That said this is not what happened here as per this judgement with the judge saying that Zumwe did extend the return favour, but Senkwe is correct, Zuma still needs his day in court. Even if the world now knows he is guilty and never to be president of SA.

ZaB, true - I should have said 'soliciting and knowingly receiving', which is obviously what happened here. An M&G article yesterday pointed out that prosecuting Zuma may not be as easy as charging Shaik as the evidentiary rules will be different, and there's more scope for the same witness' testimony to be confused and contradicted in a second trial. So it's quite possible that Zuma won't be charged and won't be found guilty of a crime.

It's obvious though, and it's now a legal finding, that he was a willing party to a 'corrupt relationship', and I think that should be enough for him to get the boot.
